The Litigation Directorate has two divisions: Procedural Representation and International Arbitration and Procedures, and performs the following functions provided for in Article 34 of the Structural Regulations of the Ministry of Finance:

• Carries out the procedural representation of the state, the Minister and the Ministry under legal and arbitration proceedings before the judicial authorities in the country;
• Carries out the procedural representation of the Minister and the Ministry before the Commission for Protection against Discrimination and the Commission for Protection of Competition;
• Organizes, coordinates and manages the protection of the Bulgarian state in international arbitration cases;
• Carries out the procedural representation of the Bulgarian state in foreign jurisdictions, including in international arbitration proceedings;
• Prepares opinions under constitutional cases whereto the Minister is an interested party;
• Takes part in the preparation and agreement of positions on preliminary rulings to the Court of the European Union which refer to issues within the remit of the Directorate;
• Ensures the fulfilment of the procedural obligations of the Minister and the Ministry resulting from the European Union regulations in addition to the cases where another directorate from the specialised administration of the Ministry is vested with the relevant functional competence;
• Assists the Minister and the directorates of the Ministry with any legal matters related to European Union regulations referring to the powers of the Minister and the functions of the Ministry;
• Analyses the existing legislation and court case-law in the area of civil, commercial and administrative law and the decisions of the Constitutional Court related to the activity of the Ministry, and makes proposals for improvement and proper application of the statutory instruments in the sphere of finance;
• Coordinates agreements whereto the Ministry is a party in terms of their lawfulness;
• Undertakes the required legal actions to collect the awarded pecuniary claims of the Ministry;
• Delivers opinions on the legal grounds for the execution of judicial decisions which have become res judicata;
• Takes part in the coordination of draft amendments and supplements of the procedural legislation;
• Prepares drafts of penal orders in the cases where the Minister of Finance is the authority imposing administrative sanctions;
• Draws up opinions on legal issues in connection with on-going and future legal and arbitration proceedings;
• Proposes the undertaking of measures on grounds of legal conformity for cessation of law violations and elimination of the causes and conditions that give rise to such violations.
