THE MINISTRY OF FINANCE AND THE NATIONAL REVENUE AGENCY (NRA) PROPOSED TWO OPTIONS FOR LEGISLATIVE CHANGES RELATED TO THE DECISION OF THE CONSTITUTIONAL COURT ON THE SINGLE ACCOUNT

"The Ministry of Finance and NRA presented at a meeting with representatives of the trade unions and of the businesses two options for legislative changes related to the decision of the Constitutional Court (CC) on the single account", Deputy Minister of Finance Lyudmila Petkova stated before journalists after the meeting. She added that a preliminary analysis of the CC decision had been made together with the NRA and the proposals were drafted to react as soon as possible while choosing the most effective for the businesses and the revenue administration option so as not to hinder the payment of taxes and social security and health insurance contributions.
A draft to amend the Tax and Social Security Procedure Code (TSSPC) has been prepared. The first option foresees the single account to be divided into four sub-accounts - for taxes, for social security contributions, for additional mandatory pension insurance and for health insurance contributions. For all those the principle of the single account will be valid - the oldest liabilities to be paid first. The second option proposes one account with 4 codes for type of payment.
Petkova added that both options provided for transitional period. For the sums paid in the single account but not yet bound with obligations under declarations an option is provided to the persons within 3 months of entering into force of the amendments to the TSSPC to state which obligation should be covered. The Deputy Minister added that in the case of the four accounts option the information from the single account would be transferred most smoothly and there would be no problems with the data base or the transferred information.
She specified that before the introduction of the single account obligations were covered by the sequence they had arisen which as a principle was maintained in both proposed options. "All that has been introduced and has led to improvement of the single account - e-services offered by the NRA, the legal possibility to first pay the principal and then the interest for delay, as well the possibility to use deferral and rescheduling of public liabilities in arrears - will be maintained and further developed", Petkova commented.
The statement of the type of obligation that the persons wish to pay, will be made under rules, procedures and in a format determined by an order of the Minister of Finance that will be published on the websites of the Ministry of Finance and the NRA.
